MEMORANDUM OF UNDERSTANDING
AMONGST THE MEMBER LIBRARIES OF THE WYOMING DEPOSITORY LIBRARY CONSORTIUM
CONCERNING THE ROLES AND RESPONSIBILITIES OF ALL LIBRARIES INVOLVED.
- Parties. This Memorandum of Understanding (hereinafter
referred to as "MOU") is made and entered into by and between the Campbell
County Public Library, whose address is 4101 4 J Road Gillette, WY 82718-5202,
Central Wyoming College Library, whose address is 2660 Peck Avenue Riverton, WY
82501, Natrona County Public Library, whose address is 307 E. 2nd Street
Casper, WY 82601-2505, Northwest College John Taggart Hinckley Library, whose
address is 231 West Sixth Street Powell, WY 82435, Sheridan College Griffith
Memorial Library, whose address is 3059 Coffeen Avenue, P.O. Box 1500 Sheridan,
WY 82801-1500, University of Wyoming Coe Library, whose address is 13th &
Ivinson, P.O. Box 3334, Laramie, WY 82071-3334, University of Wyoming George W.
Hopper Law Library, whose address is P.O. Box 3035 University Station, Laramie,
WY 82071-3035, Western Wyoming Community College Library, whose address is 2500
College Drive, P.O. Box 428 Rock Springs, WY 82902-0428, Wyoming State Law
Library, whose address is Supreme Court/State Library Building, 2301 Capitol
Avenue Cheyenne, WY 82002-0060 and Department of Administration and
Information, State Library Division, whose address is Supreme Court/State
Library Building, 2301 Capitol Avenue Cheyenne, WY.
The above parties, recognizing the value of federal government information
and the federal depository library system; and, recognizing that access to this
information is important to the citizens of Wyoming and the region; and,
acknowledging the responsibilities and benefits of the depository library
system, have agreed to establish the Wyoming Depository Library Consortium.
- Purpose. The purpose of this MOU is to establish the Wyoming
Depository Library Consortium (Hereinafter "the Consortium").
The Consortium will work together to:
- Provide access to federal government information of all time periods and
formats for the citizens of Wyoming and the region;
- Provide support and training for its members;
- Provide support and training to other Wyoming non-depository libraries to
assure that their library users have equal access to federal government
information;
- Promote the depository library system and its goal to assure continued free
and equal access to federal government information;
- Recognize and utilize other sources of federal government information such
as the Patent and Trademark Depository Library System and the State Data
Centers.
- Term of MOU. This MOU shall commence upon the day and date
last signed and executed by the duly authorized representatives of the parties
to this MOU, and shall remain in full force and effect until terminated.
This MOU may be terminated, without cause, by any party upon thirty (30)
days written notice, which notice shall be delivered by hand or by certified
mail.
- Payment No payment shall be made to any party by the other
party as a result of this MOU.
- Responsibilities of All Members of Consortium.
- We understand and are willing to accept responsibility in depository
administration as a group.
- The Consortium will work together through CARL and WYLD to provide
bibliographic access to government publications from 1976 through the present.
Efforts will also be made to provide bibliographic access to the holdings of
those libraries who are not CARL or WYLD participants.
- The Consortium will develop means to identify Consortium holdings for
pre-1976 publications.
- The Consortium will develop methods and procedures to provide for
interlibrary loan and reference services among members before requesting these
services from Regional Library. This will include sending ILL requests through
the State Library if a consortium member does not have OCLC and utilizing
Wyoming sources to answer reference questions before going to the Regional
Library. e.g. WYLD WSLILL function, ARIEL, telephone, etc. Wyoming Libraries'
policies designed to avoid duplication of effort need to be followed.
- The Consortium will develop methods and procedures to provide for support
and training among members before requesting these services from Regional
Library.
- The Consortium will draft a cooperative collection development policy which
supports retention of all items of current and historical value to Wyoming and
recognizes strengths and needs of individual consortium libraries.
- The Consortium will share information that may be of interest to members
and Regional Library utilizing e-mail, WYOGOPUB-L, ARIEL, U.S. mail, meetings,
telephone, and fax.
- The Consortium will participate in and contribute to organizations such as
ALA GODORT, AALL Government Documents Section, WLA Government Information
Section, and MPLA Government Documents Section.
- The Consortium will work in partnership with the Regional Library to help
them meet their requirements as a Regional Depository Library.
- Responsibilities of Campbell County Public Library.
- Participate in the project to provide access to GPO publications on
WYLD.
- Provide training for staff and patrons to assure access to the CARL/WYLD
network.
- Provide training reflecting collection strength(s) and staff
expertise.
- Responsibilities of Central Wyoming College Library.
- Participate in the project to provide access to GPO publications on
WYLD.
- Provide training for staff and patrons to assure access to the CARL/WYLD
network.
- Provide training reflecting collection strength(s) and staff
expertise.
- Responsibilities of Natrona County Public Library.
- Participate in the project to provide access to GPO publications on
WYLD.
- Provide training for staff and patrons to assure access to the CARL/WYLD
network.
- Provide training reflecting collection strength(s) and staff
expertise.
- Responsibilities of Northwest College John Taggart Hinckley
Library.
- Participate in the project to provide access to GPO publications on
WYLD.
- Provide training for staff and patrons to assure access to the CARL/WYLD
network.
- Provide training reflecting collection strength(s) and staff
expertise.
- Responsibilities of Sheridan College Griffith Memorial
Library.
- Participate in the project to provide access to GPO publications on
WYLD.
- Provide training for staff and patrons to assure access to the CARL/WYLD
network.
- Provide training reflecting collection strength(s) and staff
expertise.
- Responsibilities of the University of Wyoming Coe Library.
- Provide access to GPO publications through CARL.
- Provide training for staff and patrons to assure access to the CARL/WYLD
network.
- Retain and share copies of "Shipping Lists" for previous 5 years.
- Provide training reflecting collection strength(s) and staff
expertise.
- Responsibilities of the University of Wyoming George W. Hopper Law
Library.
- Work with consortium members to develop access to library's holdings.
- Provide training reflecting collection strength(s) and staff
expertise.
- Responsibilities of Western Wyoming Community College
Library.
- Participate in the project to provide access to GPO publications on
WYLD.
- Provide training for staff and patrons to assure access to the CARL/WYLD
network.
- Provide training reflecting collection strength(s) and staff
expertise.
- Responsibilities of the Wyoming State Law Library.
- Participate in the project to provide access to GPO publications on
WYLD.
- Provide training for staff and patrons to assure access to the CARL/WYLD
network.
- Provide training reflecting collection strength(s) and staff
expertise.
- Responsibilities of the Department of Administration and Information,
State Library Division .
- Participate in the project to provide access to GPO publications on
WYLD.
- Provide training for staff and patrons to assure access to the CARL/WYLD
network.
- Retain and share copies of "Shipping Lists." [WSL retains 1992-]
- Provide training reflecting collection strength(s) and staff
expertise.
- Provide access to GPO Access through Wyoming and State Library Home
Pages.
- Provide OCLC services to non OCLC libraries to facilitate ILL requests to
the University of Colorado at Boulder, Norlin Library.
- Act as central point of contact for federal government information
reference questions from WYLD libraries (Utilize WSLILL, ARIEL, Fax, or
telephone).
- Provide database searching (Marcive CD, DIALOG, etc.) for Consortium beyond
the CARL/WYLD database offerings.
- Provide consulting regarding WYLD/Marcive project, general federal
depository library management and training needs.
- Maintain "Services Contract Between the Wyoming Department of
Administration and Information, State Library Division and the University of
Colorado at Boulder, Norlin Library." to provide Regional Depository
Library Services for the Consortium. (Appendix A)
- Coordinate development of policies-i.e. collection development and
access.
- Monitor Govdoc-L and forward significant items to Consortium members who
request the service.
- Make effort to attend GPO Depository Library meetings.
- Subscribe to Uncover table of contents service and forward results to
Consortium members who request the service.
- General Provisions.
- Amendments. Any party may request changes in this MOU. Any changes,
modifications, revisions or amendments to this MOU which are mutually agreed
upon by and between the parties to this MOU shall be incorporated by written
instrument, executed and signed by all parties to this MOU.
- Applicable Law The construction, interpretation and enforcement of
this MOU shall be governed by the laws of the State of Wyoming. The courts of
the State of Wyoming shall have jurisdiction over any action arising out of
this MOU and over the parties, and the venue shall be the First Judicial
District, Laramie County, Wyoming.
- Entirety of Agreement. This MOU, consisting of seven (7) pages,
represents the entire and integrated agreement between the parties and
supersedes all prior negations, representations and agreements, whether written
or oral.
- Prior Approval. This MOU shall not be binding upon any party unless
this MOU has been reduced to writing before performance begins as described
under the terms of this MOU, and unless this MOU is approved as to form by the
Attorney General or his representative.
- Severability. Should any portion of this MOU be judicially
determined to be illegal or unenforceable, the remainder of the MOU shall
continue in full force and effect, and any party may renegotiate the terms
affected by the severance.
- Sovereign Immunity. The State of Wyoming and individual consortium
members do not waive their sovereign immunity by entering into this MOU and
each fully retains all immunities and defenses provided by law with respect to
any action based on or occurring as a result of this MOU.
- Third Party Beneficiary Rights The parties do not intend to create
in any other individual or entity the status of third party beneficiary, and
this MOU shall not be construed so as to create such status. The rights, duties
and obligations contained in this MOU shall operate only between the parties to
this MOU, and shall inure solely to the benefit of the parties to this MOU. The
provisions of this MOU are intended only to assist the parties in determining
and performing their obligations under this MOU. The parties to this MOU intend
and expressly agree that only parties signatory to this MOU shall have any
legal or equitable right to seek to enforce this MOU, to seek any remedy
arising out of a party's performance or failure to perform any term or
condition of this MOU, or to bring an action for the breach of this MOU.
- Signatures. In witness whereof, the parties to this MOU
through their duly authorized representatives have executed this MOU on the
days and dates set out below, and certify that they have read, understood, and
agreed to the terms and conditions of this MOU as set forth herein.
The effective date of this MOU is the date of the signature last affixed to
this Memorandum of Agreement.
